I thought Malpractice and Wrongful Death was hard to prove. So wouldn't Doctors and Hospitals have the advantage in Court? If so, why do so many settle out of Court?

It's usually a matter of which is cheaper for the insurance company to do. Once you have an insurance policy, you basically agree to abide by what they want to do. When the lawyers of the insurance policy take a look at the facts and circumstances of the case, they may decide that it's cheaper to settle out of court. When there's a jury, they are frequently on the side of the victim because afterall, they have occasionally experienced medical mistakes.

Jury trials in such suits can go on forever at great expense. Usually, also, the plaintiff will leap at an offer.

Also, it would be more cost effective to shell out a negotiated award to the plaintiff then risk some insane jury decision that is based more on emotion than fact.

You want the Doctor or hospital to go on with their jobs, making sure they are more cautious in what they are doing, as oppose to taking away their license as caregivers.

It is a Long and costly process to sue or defend yourself against a lawsuit. Most insurance companies fell it is more cost effective to just settle out of court than maybe lose and have a huge judgment against them.In the end it all about how much they have to spend not whether your right or wrong.
