I went for a uterus removal operation in Apllo hospital kolkata. After the operation I was feeling severe pain. but the doctor suggested its normal after operation. As the time passed he suggested to take painkillers. After 3 months as the pain worsened went for a CT scan which reveled some thing. The doctor asked me to come there as he suspects it to be some disease which might not be handled by the local doctors. But we came to another hospital and in then they found a sponge inside the stomach. Now how can i pursue this case.

There have been similar cases here in Australia and some have succesfully settled out of court. In these cases, hospitals in particular have been found liable because they have nurses who are trained to keep count of the surgical instruments including sponges used during the procedure. A miscount/incorrect recording can be considered as a breach in standard of care. Compensation may be awarded if you have suffered damage. The damage that you have suffered in this instance is the need to have a further operation to have the sponge removed, pain and suffering etc and associated sequelae (such as infection from having a foreign object in your body).
