This is for an american gov. paper for school, and I'm supposed to ask for people's opinions on questions like this one...so if you would be kind enough to help me out, I would really appreciate it.

Commons sense says it should be limited to actual damages, reasonable loss of earnings and realisitc cap figures for pain and suffering.

Suppose you are having a run of the mill operation. Your surgeon shows up drunk and cuts an artery and you bleed to death on the operating table.
Should there be a cap on your suit against the drunk surgeon?
Suppose the surgeon is supposed to remove your left kidney, which is failing, but he goofs up and removes your good right kidney? You die of kidney failure.
Should there be a cap on your suit against the surgeon?
Suppose you have an implanted pain medication pump for back pain. Your doctor does not know how to properly refill the pump, misses it injects a lethal dose of morphine directly into your body, and you die.

Your doctor recommends elective surgery. He fails to tell you that that there is a 40% chance you will lose your eyesight. You would not have risk the surgery if you had known that. You have the surgery and lose your eyesight.

Incompetent and careless doctors kill and maim people every week. I have represented some of their victims.
If you put caps on malpractice suits, these doctors will not be held accountable for their incompetence and carelessness.

yes, people go overboard on this. In my opinion I think allot of them cause mistakes on themselves by lying just to cause malpractice so they can sue for millions.

I think there should be a limit on the pain and suffering part. People are greedy and try to claim far more than they are entitled to in this category.
All costs associated with the medical procedures and law suit (assuming you win) should be covered as well as "something" for pain and suffering.
However; I would like to see stiffer penalties levied on the doctor's ability to continue to practice if found guilty. Probation to a medical board, loss of license to practice etc. should become the penalty rather than insurance companies paying out huge sums.
Hit 'em where it hurts... their livelihood.
