Is this considered Medical Negligence?

I recently had a procedure done called an EGD. When I went back to the room, the nurses were suppose to start an IV. After 4 attempts none of them were able to start one. With the time consuming efforts it was putting the procedure behind. Finally, the anesthesiologist came in saying she had to leave in 10 minutes and that she would do it. She poked me once in the left side of my forefinger (hurt like the dickens) when she didn't get it that time she immediately removed it and went to my inner wrist area. She never used iodine or alcohol to wipe it and she used the same exact HUGE needle in my wrist. I know for a fact she was in a hurry to get it done so they could get me in the op room to do the procedure. What type of action do I have against this woman. Mind you this is not a little butterfly needle.

No, it's not like you're gonna get a disease from yourself. It's common to have to try a few times to find a good vein, especially on heavier people.

There's no doubt they acted unprofessionally, but legally, there's nothing you can do. It would come down to he said she said and unless they documented everything in your medical record, which probably didn't happen, then you wouldn't be able to prove it. If you got an infection from the area then you could go to your doctor and he could prescribe some medication for you. I know you must be frustrated. I think the best thing you can do for yourself though would be to put it behind you, not dwell on it, and just move on. Just keep an eye on the place that they inserted the needle and make sure it heals properly. You really shouldn't have any problems with it. Sorry you had to go through that. Take care!

You don't really have grounds to complain or sue over this, since no apparent problems have arisen as a result of her actions. The fact that she didn't use alcohol or any other form of cleaning agent is slightly worrying however.
