law: if school get sued for teachers molested young boys. is that negligence?

ok , i am studying law, and bit lost.

this is the case: " KNOX GRAMMAR SCHOOL, where four teachers molested young boys, is being sued for more than $ 1 million over claims it neglected its duty of care to one alleged victim "

what topic/law will this case be ? will it be negligence? and can you tell me why it is.

is they a Similar cases with a pieces of legislation ?
like an Australian statute related to this article or a similar case?

I am not from Australia, but I might be able to assist. Most states in the U.S. allow actions for negligent hiring. The backgrounds of the particular teachers accused will determine whether or not the school was negligent in hiring the teachers in question. As to negligence, certainly there is a claim here. School is a place where your parents and students should be able to go with some level of certainty that they will be safe. The school does have a duty to ensure the safety and well being of its student. Where certain teachers are allowed, permitted or even able to breach that peace of mind that shoud be associated with schools, there is no doubt that the school was negligent. It is not a requirement that they knew or should have known, that only pertains to inent, here simply becuase the allegations, if proven, occured the school is responsible.
