Your firm has accepted representation of a new client, Ms. Ingram, who was injured as she was walking down the steps of her apartment building. She tells you that her leg hurts very bad and that she fell down two flights of steps. When you ask her how she fell, she tells you that she is not too sure as she does not remember much and thinks she might have "blanked out." She tells you that the lights in the staircase area are not too bright and it is hard for someone of her age (80 years old) to see the steps clearly. She tells you that most of the people in the apartment building are elderly and they have been complaining for months about getting hand rails on both sides of the steps. Do you think that a claim for neligence exist against the owner of the apartment complex? Do you think the elements of negligence can be satisfied? She might be bad at seeing because of her old age, you must first inverstigate the stairway she claims she fell down, then find if it is possible to fall down all of those steps, if it was 2 flights, did she roll?
