I have a medical malpractice suit. About 10 days ago i rejected the case evaluation offer. Now i got a call from my lawyers secretary saying my lawyer wants me to come in today to discuss a possible settlement offer. Now i know that a settlement offer tries to keep the case out of court, but is it like the case evaluation where both sides have to agree, or is this more like my lawyer and their lawyer came up with this, and i have to decide? How does that process work? Is it a good sign that theres an offer so soon after rejecting the case evaluation? i was told i would have to wait 42 days for a settlement hearing, now 10 days later theres an offer? Anyways, any info on what exactly the offer is, how it was decided, etc. I dont want to bother my lawyer with these questions right now, im just curious before i go in what it all means. Thanks!
