You can try but I doubt that it will go very far. Hospitals have the right to refuse patients due to non insurance unless it is a matter of life or death. The only exception to this is if you live in a state where the law mandates otherwise or if the hospital is not-for-profit.
What did you go to the ER for? Why did it take a week to find out you had a chronic illness? Would the ER have been able to make the diagnosis? More details are needed, sorry.

Have you been to that ER department before and, if so, why and when? When was the last time you sought any medical help and how often? (This is just to make sure they don't think you are a hypochondriac.)You need to get a copy of your medical records from the hospital. Check to see which questions were asked and how you answered them. They should have given you a chart of a body and have you circle the area's where you were feeling pain. You need a copy of that also. Did you say you had blood in your urine, or pain, or what? What notations were made regarding your complaints? Did you make it out of the waiting room before they dismissed your problem or were you turned away as soon as they found our you were uninsured? When and where did you next seek medical consult? How long after getting other medical care did they make a diagnosis? Sorry to give you this many questions, but you'll need to have all this information before anything can be done. Negligence is hard to prove, excluding death, you just can't sue for the care not being what you wanted.

Go to the hospital and get a copy of your records -then- contact a lawyer. You risk something happening to the records if you don't get a copy first. A half hour consultation with a lawyer should be reasonable. Some lawyers will waive that fee if they take your case on a contigency bases.

This happened to a friend of mine. He collected a very large sum. However, his case was one of clear negligence and misdiagnosis, resulting in death. I imagine it would depend on how serious your health problem is and depend on if you needed medical attention right away.

In this country you can sue anyone for anything,. There are no limitations.
