In August of 95 (12 yrs ago), after more than 4 yrs of being misdiagnosed, docs rushed me into surgery to remove my appendix when I was only 6 years old.Since I was an infant my parents had taken me to numerous doctors being I had chronic UTI's and vomiting. They would claim it was gas or accuse my parents of abuse. Nobody ever did an ultrasound. When they finally went in to remove my appendix due to "appendicitis" they found a black, walnut size kidney and realized they had made a mistake. They stitched me up and told my parents to come back a few weeks later to have the dead kidney taken out. Along with the kidney they took out as much of the ureter tube as possible but left about 1/4 of it. Over the last few years I have been getting reoccuring infections and UTI's yet again. Yesterday I went to a urologist because I had intense back pain and he determined that because they left part of my ureter tube it became a sac of infection that now requires further surgery. Can I still sue?

Med Malpractice Statutes of limitation vary by state. Typically, they are rather short. Consult with an attorney in your locale who handles malpractice.

You need to consult an attorney, but in some instances the statute may not start running until you are 18. I would suggest you gather all of your medical records from back when you were six years old until the present and take them with you when you consult the attorney. They are going to want to review those records and get all of the facts before telling you whether you have case or not.
Addendum: There are capitations on the amount you are allowed to recover in some instances.

Prepare your evidences... You will certainly win on this one... Decision should come down after a few weeks of hearing and review...
The amount you'll receive though would depend on the appraisal and decision of the judge on how much he will penalize or charge the perpetrators...
My suggestion is for you to threaten filing a lawsuit but is open to talk about it sucking their bank accounts dry...
