I was supposed to have my impacted lower bottom wisdom tooth extracted. I informed the Surgeon's staff, the Receptionist, and the appt setter that the lower bottom wisdom tooth needed to be pulled.
The day of my operation, I noticed that when I sat in their chair and they hooked me with an IV, they DID NOT take X-rays to see what was going on with my mouth AND they had my chart (or maybe someone elses?) on the screen that displayed just my top teeth. Again, I informed them that the problem was on the left hand side on the BOTTOM. When I woke up, I noticed the gauze pads were on the right side of my mouth. To my horror, the surgeon cut me on the top right of my mouth. When I asked them to put me under and take out the right tooth, they told me by law even though I'm coherent, their hands are tied. They reimbursed me and booked an appt for 2 weeks and will take out the other wisdome tooth for free.
I want to sue, but how much is the question? I'm in a lot of pain and discomfort. =(

would you have a shot of winning? Dr's have heavy malpractice insurance and it would be easier to settle it out of court, ie get free treatment or just go to a different Dr.

I doubt that was the real scenario. You are probably only in pain because you want to be. At least you wont need them out in the future. Chin up tiger.
