If a lawyer advises a client to do something illegal, is the lawyer protected because none of the records relating to giving that advice can be released in discovery?
For example, if a lawyer for a local government entity says that a contract can just be awarded without bid even if it is over the dollar amount required for bids, and a favored local contractor gerts the bid, is the lawyer immune from prosecution because of the attorney-client privilege?

no in criminal acts a judge can subpoena both the client and the lawyer and the confidentiality is out the window

Lawyers don't tell you what to do, only advise you of what you should do, and the consequences

NO! A lawyer is a officer of the court and if a law is broken so is the privilege. So if the attorney advises the client to break the law he should be reported forthwith! ~M~

Pascha, what part of the term "ILLEGAL"DO YOU NOT UNDERSTAND?
A lawyer client relationship is a contract and as an element of a contract all parts must be legal on the surface. E.g. A mafia contract to wack someone is not a contract.
