I'm trying to decide if i should take a disagreement to arbitration with the BBB. I'm wondering if i should get an attorney to assist me in the manner. If I win a case who pays my lawyer? If I lose a case who pays my lawyer?

In most cases if you win only then will your lawyer deduct their fee's from your settlement. It really depends on the agreement you enter initially with the lawyer. The same is true if you lose, then most lawyers policy is that then you owe them nothing. good luck :)

There's no hard and fast rule on this. You'll work out the details of payment with an individual lawyer. In arbitration, typically each side is responsible for their own attorney fees (though there are excpetions, and attorney's fees can be awarded/ordered paid by either party). But what those fees are and how they are to be paid is between you and the attorney.

Some may take the case on contingency--meaning they get a percentage of what you win, and nothing if you lose.
Some may take the case on contingency, with the condition you pay out of pocket costs no matter what.
Some may take the case on an hourly fee basis.
Some may take the case on a flat fee.

Most attorneys take 30% of your win plus court cost. Win or loose, you will pay the court cost plus attorney fees. In some cases you can ask the arbitrator to also award reasonable attorney fees and court cost in addition to the damages you receive. Not every case qualifies for cost paid by the loser.

I have never heard of an attorney working for free. Win or lose, they get paid by someone. If not from the win, they get paid by you.

What do you think? Answer below!
