my husband had a bone marrow transplant, was treated for C-Diff for 3 weeks, diarrhea cont and checked and lab report is Neg for C-Diff and positive for VRE, diarrhea cont and given many drugs to stop it that caused paralized bowel, then finally checked by scope and showed grade 3 gvhd of small intestine, is this cause for malpractice, he died of all this
he did ot have C-Diff,all the Vano caused VRE (Vanco resistant enterococcus)

Unless there was direct negligence that was documented and can be proven.... I imagine it would be difficult to win *any* lawsuit over a death in a bone marrow transplant due to infection.
Now, if he was treated for c-diff while he never had c-diff but had something else that got worse... maybe.
If he had c-diff, treated for c-diff, got over c-diff, got vre, and vre killed him... Not likely at all. Close to half of the patients that go through the transplant die of before they know if it worked... usually rejection or infection. Infection is such a high risk because the patient has literally zero immune system. They can give you all the meds in the world... if you dont have an immune system it wont matter.
The only REAL way to know if you have a case is to have a medical lawyer review the medical records.

Medical Malpractice is a tricky thing to prove. I am very sorry for your loss but sometimes things just happen and there was nothing anyone could have done to prevent it. However, if you truly feel that his death was a direct result of neglect and/or something the medical staff should have or should not have done, then you must be able to prove it to have a case. A lot of times these things can tie up in court for a very long time. Having said that, most medical malpractice attorneys will offer you a free consult and it may put your mind at ease to at least speak with one. I hope this helps a bit and again, i am very sorry for your loss.
