Medical Negligence....In what cases can you sue?
On tuesday my daughter went to get her shots. The nurse that gave her the shot was not her normal one. I remember looking at the needle and thinking that needle is huge for a small 4 month old leg. She pulled the leg and jabbed the needle in. My daughter scream uncontrollably. In my mind I thinking that big needle must of hurt her. So when we got home we notice her leg wouldnt staighten out. so we pull the leg down trying to even it with the first one. My husband woke me up 2oclock in the morning and said he think its broke. it look the same way that it look after we got home from her shots. we took her to the hospital and not one but 2 doctors said her leg was not broke. so we went home thinking everything was fine. Friday I notice that her leg was still swole so I decided to get a 3rd opinion and took her to her normal doctor. She did xrays and said it was definitely broke. Now they are trying to put it on me and my husband. When we explain about what their nurse did, they didnt want to hear it. When the investigation is over and we are found innocent can we sue the 2 lazy er doc who pulled and yanked legs and said it wasnt broke.

In order to sue to win, you have to prove damages. If what they did damaged your daughter, both mentally and physically, yes you have a chance to win. The problem is that NO doctor or drug company can be sued legally now for ANY damage due to a vaccination. This most likely falls into that category.
National Childhood Vaccine Injury Act (NCVIA) of 1986 (42 U.S.C. §§ 300aa-1 to 300aa-34) was enacted in the United States to reduce the potential financial liability of vaccine makers due to vaccine injury claims, so we are told. I find it astonishing that pharmaceutical companies, doctors, and health professionals keep promoting the idea that vaccines are safe and, yet, if they were really safe, why did we need to pass a law protecting doctors and the companies manufacturing vaccines from being sued as a result of vaccines damaging people? So far, we the tax payers have paid out almost 2 billion dollars of tax payer dollars to VICTIMS of vaccine damages.
Intelligent people are now refusing to allow these ridiculous POISON INJECTIONS to be done to our children. The evidence is clear, concise, and irrefutable as to how it is causing far more harm than any possible good. Here is an excellent article for you to read:

If you think you can trust drug companies propaganda regarding vaccines, just watch what the BAYER pharmaceutical company did to homophiliacs:

Merck pharmaceutical company lied to the FDA and ended up killing about 160,000 people from putting VIOXX on the market knowing that 30% of the people taking it would be harmed and even die from taking that junk.
Is it no wonder more people are killed from doctor induced illnesses each year than any one single major disease in America today.
In July 2004, Gary Null Ph.D, Carolyn Dean M.D., N.D, Martin Feldman M.D., Debora Rasio M.D., Dorothy Smith Ph.D. wrote a paper that revealed very disturbing facts regarding an annual iatrogenic (induced inadvertently by a physician or surgeon or by medical treatment or diagnostic procedures) death rate of 783,936 in one year. It is further disturbing to realize that as few as 5 percent and only up to 20 percent of iatrogenic acts are ever reported. This means that that iatrogenic death rate of 783,936 is much higher.
As we look at the causes of death from degenerative diseases and other causes in America in 2004, it is obvious we are not good at solving this problem on any level. Deaths from: Heart Disease 652,000, Cancer 553,000, and Stroke 150,000.
When comparing the iatrogenic acts of modern medicine in America with the statistical numbers of people dying of any particular disease, it is evident that the American medical system is the leading cause of death and injury in the United States. And when we look at the cost of these iatrogenic deaths, the cost is in the billions.
good luck to you
