My friend had surgery a while back and the hospital has no record of this. Her insurance was charged for it though and she has the scar. The surgery was done incorrectly. She doesn't have money for a lawyer, so she hasn't pursued a claim yet. If it has been around 5 years, can she still file?

The limit is 2 years from the act, or if the exact date of the act is not known, 2 years from the end of hospitalization during which the act happened.

Most States have a 7 year Statue of Limitations on civil cases. You can call your local office of the State Attorney to find out for sure and to obtain the specifics. Does she have any type of records for the surgery - date, doctor (surgeon) who perfomed the surgery, a copy of the charges sent to her insurance company, information as to how the surgery was done incorrectly? Having a scar doesn't prove who did the operation nor where it was done. And if it was done incorrectly, why did she wait 5 yrs before wanting to file a claim?
