Tort reform puts a cap on the level of compensation a family may receive from medical malpractice.

Infants receive brain damage because of the negligence of the others leaving that child in the care of others for the rest of his life.

If families have a good case don't they deserve the money they receive from a malpractice law suit?

Because tort reform doesn't limit the amount that can be rewarded for future medical expenses due to malpractice. It limits punitive damages instead, which are the damages that make shysters rich. So there are people arguing against tort reform. They're called lawyers.

I have never heard of tort reform proposal that prevents victims from getting pay-outs. The tort reforms proposed and adopted by certain states (e.g. Texas) attempt to cut down on frivolous law-suits, like
spilling coffee on one's crotch and sitting in the hot coffee for ten minutes then suing McDonald's.

If we can put a "value" on things like the amount of electronic gear the electric company destroys surging thier product thru your lines why can't we put a fair cap on the value of a human life? 1 mill max, 2, 5 whatever, put a $ $ $ cap on it so it puts a window around the maximum outlay and insurance rates will fall along with corresponding health care premiums. Toss in products liability reform and now you have a path to lower health care premiums.

Never happen as long as lawyers rule the roost. Both parties are fed by this beast the Ds more than the Rs.

They are. Tort reform is used by the right as a way of appearing reasonable while they sabotage the reforms. Mind you, the reforms will result in lower malpractice payments. At present, the payouts are high as they have to pay for the costs of on going healthcare. As (un)insurance companies refuse to cover pre-existing conditions, the costs have to be high. If the insurance companies are forced to cover pre-existing conditions, then the payouts will fall in price, which means that overall health costs will fall as well.

I do not understand why so many Americans have fallen for lies about healthcare in the USA, abroad and also the planned reforms [1]. I mean, if the healthcare system in the USA is so good, why have no other nations taken it up? Could it be due to the following facts?
FACT - the USA spends more on healthcare PER PERSON than any other nation on the planet [2].
FACT - the US has higher death rates for kids under five than western European countries with universal health coverage [3].
Or if the US healthcare system is run so well, why not run the fire service like the healthcare system? [4]

Obama wants to make insurance cheaper, stop insurance companies from refusing health coverage to those with pre-existing conditions, and make sure they pay out when they are meant to [6], a system similar to that which works in Taiwan [7]. He debated this before he was elected [8].
Is it right that a dead American four year old would have had a better chance of life if they were born in Canada, Cuba, Germany and so many other industrialised nations with universal healthcare?
