Hi, just wanted to get opinions on how many of you would sue someone if they gave you bad medical advice and you got really sick afterwards and continue to have health issues years later? See someone gave me some really bad advice when I was younger and I got really sick shortly after - within a month of having been given the bad advice and my health was never the same. I went from a perfectly healthy vibrant active teenager (I was still a teen at the time) to a very sick young lady afterwards. My goals and dreams have been shattered and I am 100% sure that this bad medical advice I was given when I was still a teen, is the reason why. I never decided to pursue any action against this person because this person is a family member and I don't believe they were actually trying to harm me, at least I hope not, but the advice did harm me. It harmed and damaged me big time, both physically and emotionally. If you could prove that the medical advice did harm to your being, would you sue that person even if they were a close relative? I have already consulted a lawyer and he told me if I could prove that I have damage due to the bad medical advice that I could sue this person for negligence and negligent infliction of emotional distress.
FYI - the person that gave me this advice was my own mother
The only reason I'm even considering suing is because I haven't been able to live a normal life since and have since then even had to have surgery of a major organ which I believe the organ was damaged due to the bad medical advice I was given - no i didn't have to take it, but i trusted my mother and never thought she'd ever do anything that would ever harm me - mother's are supposed to protect their children no matter what!!!

You can't.
He/she can give you bad medical advice, but if he is NOT a doctor and he is NOT charging you then you have no claim. It is YOUR responsibility, the lawyer that told you that is likely after your money, that suit would be dismissed there is no LEGAL basis for it.

this person wasnt a doctor so it was essentialy YOUR choice to accept his advice this is what will be argued in court im afraid

not really, that person isn't in a position to give you medical advice, so you shouldn't of took it. that's like a friend telling me to pull my own tooth out for fun. Then finding out it wasn't fun and sueing them

I don't think it's possible in law to sue someone who gave you an opinion without taking money or professing to have any professional expertise in the area of health care. I'm sorry you've suffered and all, but suing the person would not make you better, now would it?

If you were a minor and that person was your parent or guardian then I think that you probably could sue them. They were responsible for your health and well-being. Good luck.

First: you will have to prove this person GAVE the advice.
2: You'd have to prove that the person knew that you would rely upon this advice
3: You'd have to prove that this advice resulted directly in whatever problems you had later
I'd say your chance are 1 in 10,000, conservatively.

Your lawyer is a quack or you did not tell the lawyer the same things you said here. You take medical advice from your mother or anyone but a physician at your peril.
