Is This Medical Malpractice?
Please tell me if this is medical malpractice...
I had strep in June.
I had uncontrollable jerking of my limbs.
A rash on my elbows.
Emotional wreck.
Joint pain.
Joints were swollen.
Heart felt like it was pounding out of my chest.
Fever.
And nose bleeds.
In September of 2009 I had Rheumatic Fever with Sydenham's Chorea and I went to a local ER and when they asked what I have been doing different or been to the hospital for in the past 6 months I told them the only things were I changed my birth control from Yaz to the depo shot, and I had strep throat... When I told the doctor strep throat he said that couldn't possibly be the cause of my issues. The doctor's diagnosis was I was allergic to air... Not allergic to something in the air just air.
So I was given a shot of Benadryll and told I'd be fine the next day. I was not ok the next day and went to another ER an hour away and that hospital asked the same thing and I told them the depo shot and strep throat and I was told again none of those could be the cause of these symptoms. And they diagnosed me as having a month long panic attack, and gave me ativan and told me to call a therapist to keep my anxiety in check. Well none of this helped, I had to wait a week to see my family doctor and he couldn't tell me anything he gave me valium to help me sleep bc at this point i hadn't slept in about a month bc of the Sydenham's Chorea I could not hold still long enough to fall asleep. I was told if the valium didn't help me sleep or if my symptoms got worse to go to a hospital he recommended. Later that night things got so much worse and we went to this ER and they didn't know what was going on other than I was close to having a heart attack. So they sedated me and sent me to another hospital that would know better than they did what to do. After another 5 days of being sedated at this hospital they finally diagnosed me with Rheumatic Fever and Sydenham's Chorea after my rapid strep results came back positive.
I now have mitral valve damage.
Have to take penicilln twice a day for the rest of my life.
I was told not to get pregnant because it would risk my life and the baby's.
And if I get strep throat again there's a 97% chance of me getting Rheumatic Fever again and if it isn't caught and treated immediately there's a high risk of it killing me.

Don't know. How common is Rheumatic Fever? Did the doctor depart from a standard of practice of those with similar training and experience? Many people have to get 2nd or 3rd opinions because they don't agree with the diagnosis or treatment. Maybe instead of going to the ER you should have seen your Primary right away and had him refer you to a specialist. ER is for emergencies, you know heart attack, stroke, severed limb, etc. You can't expect an ER doc to know the symptoms for every virus, disease, aliment there is. I don't think you have a case against the ER docs.
