is this medical malpractice?

sept 09 had a cat scan and it showed a mass coming from the tail of my pancreas. Got the results when i saw my doctor in Jan 10. she sent me for a biopsy, radiologist said she could not do biopsy due to mass surrounding all vital organs, she suggested a surgical biopsy. My doctor sent me to surgery to remove mass. Had surgery Jan 27. When I woke up surgeon stated there was no mass nothing there. He did not remove anything I have the cat scan film and a letter showing the mass is there. His report states no mass or anything. He will do a cat scan on me next week. Is this an error, I have a scar, messed up emotional and physical, sent out some emails for legal advice. what should I do. I scared

A biopsy is an exploratory surgery. They explored and found nothing. Be grateful.

CAT scans are usually 100 % reliable.

You can do what you want but i'm sure the hospital will be able to explain everything to suit a lawyer.

What are you scared about?

Instead of worrying about suing ($ $ ), iw ould just be glad there was no mass.

That's just me. It's your choice. Legal battles can be VERY emotionally upsetting too.

For you to have a malpractice case, your going to have to prove that your Dr performed an act that caused harm to you. Its going to be hard for you to prove as it sounds like the Dr was going upon what they saw at the time of examination. The argument you will have to disprove is that they were or were not acting in your best interest. Surgery is scary, and who knows what caused the CT to show an abnormal mass. If it was a faulty machine, then you could go after the hospital themselves, but not the doctor. Again your going to have to be able to prove these things.

Will is right, you have to prove it caused you harm and it didn't. I also had an unnecessary surgery. They removed my gallbladder saying they needed to so they could put a gastric pacemaker on my stomach because my stomach muscles are paralyzed. The problem is they never got approval from the FDA first for a gastric pacemaker (who denied me) and now I have no gallbladder and nothing was wrong with my gallbladder. Not having a gallbladder does not cause problems for you so I had nothing to prove they did damage to me. Yes I have a few scars but that's not a damage. You have no damage either because of your surgery and they thought it was there since it showed up on the CT Scan. Be glad you are healthy and didn't have anything wrong with the pancreas. No need to be scared, be glad you are ok.
