Medical negligence concern...?

In mid august of 2007 i was misdiagnosed at a local hospital. a tech supposedly made an entry error regarding a urine pregnancy test and posted it as a positive result. They then informed me that i was pregnant and took me in for an ultrasound. i had a cyst but the ultrasound tech i suppose figured the cyst to be the fetus. they send me back to the room where they tell me its an ectopic pregnancy and that they need to prep me for surgery. after 3 hours of this nonsense they tell me that the blood test and urine test do not match, so they take another blood test. the blood tests are negative so they apologize for their mistake and send me on my merry way with pain pills for the cyst. sorry for the cut to the chase, informal sentences but im trying to keep it short. the question is, could i possibly file a lawsuit?

if you're educated in this field and wouldnt mind giving your opinion itd be greatly appreciated =]

that is messed up i would talk to a lawyer alot of them dont charge unless they win there cases

A lawsuit for what damages. The error was caught and corrected before any damages were done.

You can sue for whatever you want to sue for. Be a part of the problem that is stifling the American justice system. But to win you have to demonstrate damages and there are none here.

It does not equate to medical negligence. Nor is it malpractice.

It was a simple error that did not harm you in anyway. You suffer no long term permanent damage from this....why would you want to sue. Not everyone is perfect that is why they did the second test (blood test) to confirm before surgery.

Unless you were physically hurt, there is not much chance of winning a law suit. If they had done the surgery, and then found out they were mistaken. then for sure you would have cause for a lawsuit. But since you basically were just inconvienced, you will have a hard time finding a lawyer to take this on.
You for sure would want to file a complaint with the hospital bigwigs. and find out if they have a habit of making mistakes and what they are and have done about the problem.

no negligence, what do you want to sue for?

i would ask to speak with the hospitals administrator and ask that they credit your bill due to their errors.
you can ask the administrator this simple question
"do i need to get a lawyer?"

the hospital may be very receptive to the idea of paying your bill since it was an error on their part.

You didn't even leave the hospital, and o doctor told you anything incorrect. sorry,you didn't hit the lottery. Now grow up and be glad it was not more serious!
