Okay so for school I had to answer these questions and then find out how other people would answer them. So please read the short paragraph and answer the two questions that follow it with your own opinions. Thanks for any answers.
A man dies of cancer and his wife feels that he did not receive proper medical treatment. If he had, he would have survived. She files a lawsuit against the hospital and doctors. The jury awards her $ 40,000,000 in damages.
Do you feel such awards are excessive? Why or why not?
Should there be a limit on the amount that can be awarded for medical malpractice suits?

yes it is excessive because profiting off the loss of a loved one is despicable... medical malpractice suits have gotten out of hand. people make mistakes aaaaand some doctors are better than others. if you feel your doctor doesn't give you the best treatment, go to another one. people are not meant to live forever

Wikify damages / compensatory damages / punitive damages. Many states already have caps on med mal punitives.

Yes, it is excessive. But, because the money made by medical corporations are soooo big, the fines and penalties must hurt to avoid knowingly compromising care or services for profit. Perhaps award multiples should be granted to a fund for medical research or care of the indigent rather than just to litigants when certain conditions or errors are proven in the action.

I do not necessarily think it is excessive. If the fellow was raking in a couple million per year, it seems reasonable. If the death was intentional, it seems reasonable.

I would not favor a law that imposed a limit on the damages that a jury can award. I would favor better instructions on how the jury should calculate those damages, but if some doc does a couple million in damages, the jury should award a couple million. I also don't think the law should fix a minimum and require that the award be at least that much, even if the doc didn't cause that much harm. If you were going to have one, and have damages fixed without regard to the actual harm, then it seems like you ought to have both a minimum and maximum.
