I am a tenant in a private residence, one day I was leaving my house to go to work at about 4 am while it was still dark out and I tripped on a small statue that was left on the porch by my landlord. I hurt my foot and ankle and was hospitalized. Should I be liable to pay for medical bills? As far as I am concerned, this should be classified as neglect by the landlord.

Yes, that is what insurance companies and lawyers are for.

Nope That was clearly negligent if you can prove it was left in the path where someone was likely to trip over it. The landlord should cover your bill.

Yes it was, you should contact an attorney. 314-727-0702 if you're anywhere near the St. Louis area for a great attorney!

You could go after them for neglect, yes.

And that's what is wrong with our legal system. You're the one not watching where you were going, or making sure you had proper light to see where you were walking.

But yes, by all means sue them for your own clumsiness.

It was your neglect that landed you in the hospital. You should have been smart enough to look where you were stepping. You are responsible for your own bills.

Here's the way this works: it's your foot, your ankle, and your medical bill, for which you're responsible. If you'd like to recover the costs from your landlord, you have the option to negotiate with him or sue. But the hospital and the doctor did not leave the statue on the porch, so you have no reason to expect them not to bill you personally.

First, read your lease to see if anything was written that might discuss this type of thing. Go to your landlord and explain what happened. The homeowner should have homeowner's insurance to cover that cost. If your landlord refuses, you can take it to small claims court and have a good chance of winning.
Did you not have an outside light to turn on to help you see? I ask only because it may come up.

You are liable to pay the hospital.
Then you can go after the landlord.
You do not get to just "stay out of it" and tell the hospital to talk to your landlord though .
