If my health insurance pays for my medical bills and then I get a settlement from the auto insurance company of the person that hit me, do I have to pay back my health insurance company?

The auto insurance should have covered your medical bills. Your health provider may come after you for the money if you get a settlement.

Depends on the type of health insurance plan you have.

In general - if you have an ERISA plan - (an employer sponsored plan) then yes, your health insurance will subrogate. That means they will come back to you looking for repayment. Go ahead and find out now. Call the subrogation dept for your health insurance and ask them about it. Better to deal with it on the front end than a year after you settle.

If your plan is Medicare, Medicaid, Tri-care (formerly Champus) - then yes. By law, these programs have a lien against the settlement proceeds. If any of these have paid your medical bills - let your adjuster know. He/She will need to contact Medicare, Medicaid, Tri-care and find out the amount of their lien.
