In 09 I had a herniated lumbar disc,L-5. I had surgery on this disc to repair it. In Jan 10 I fell on an ice build up on my back porch steps,slamming my back down hard. An MRI shows herniation at that same disc and S-1 nerve impingement.I was able to get an attorney to take the case as the landlord is an out of State owner and I believe he has been negligent in property maintenance. I've read that herniated disc injuries often bring six figure settlements...is this true? In my case i'm not certain what an award would be as I did have surgery on this disc previously and I'm sure the ins.Co. will say it was already weak and susceptible to injury,nonetheless now I have to have injections at that area due to pain and most likely another surgery. I am presently disabled anyway due to cervical issues(fusion)..What would be a reasonable settlement for something as this?

Quite obviously u all dont get it. I leased this apt. The lanlord IS responsible for snow and Ice removal, not me ! If he lives outta State, then he MUST have a company manage the property.When he does not maintain the property, its called "Property Neglect"....He IS liable and the Lawyer I have took the case on a contingency basis.

Please don't add to the pile of unnecessary lawsuits. You sound like you are more into the money than getting a fair settlement.
Bottom line, the negligence here was yours. Watch your step next time.

Not American so not big on the whole 'sue everybody' lifestyle.
But just so i understand your landlord is supposed to drive interstate to sweep ice off your porch?

ask a lawyer.its the best choice instead of asking general public because there are Tonnes of things lawyers know and the best part is they know how TO PLAY WITH LAW.

but before u go check your contract that who is responsible for clearing snow/ice ( the one who is responsible to clear snow/ice will pay u money ( it can landlord or it can be other company)

wait a minute. you failed to clean the ice off your back porch, then you decided to go skating across it, and now you want someone to pay you money for this foolishness? not trying to be rude, but you wouldn't want me on the jury. it's your job to keep your porch free of ice. it was your choice to walk out onto the ice. it was you that fell. how is it that you feel it's someone else's responsibility? this just doesn't make any sense at all. i get it that you don't want to have to pay the hospital costs, but why should someone else?
sorry you got hurt but i wouldn't recommend you get a dime out of this. indeed, it's a frivolous lawsuit.

You have got to be kidding me, right? Your landlord is supposed to make an interstate drive to clean the snow off of your back steps? Why can't someone who lives in the home have cleaned off the steps? Of course you were able to get an attorney, they don't stand to lose anything unless they took you on contingency. If you have renter's insurance, they may pay your bills, or the home owner's insurance may even pay the bills if that is what you are looking for. Trust me, you would not want me on any jury that heard this case, I wouldn't need any time to deliberate and then I might even sue you for having wasted my time and costing me money from work.

if you already had a bad back why weren't you more careful going down the stairs? seems this is as much your fault as the landlords, don't count on a lot of $ $ . you didn't exercise due caution.
