my mother doctor was terminally ill he treated my mom in july her pressure was really up he did not offer any tests. she died a few weeks later. her doctor who was terminally ill died two weeks after she did is this a wrongful death case or a medical malpractice case. do i have grounds to sue the hospital where he was employed?

And not only that, if I had a hot dog stand and you wanted to buy a hot dog, I would not sell you one. Don't want to leave myself open for frivolous lawsuits.

The part you are missing is the part where the evidence persuades the jury that if this doctor/employee had acted different (as required be the prevailing standard of care), she would not have died. As you mentioned nothing about that, I think you have no claim.

Only if you can prove the doctor's negligence contributed to her death. Tests may have pinpointed your mother's condition and identified a possible course of action, but you would have to show that the treatment would have been successful. I'm sorry for your loss. My father died under similar circumstances in that the doctor misdiagnosed the cause of his condition, so did not order any more tests.

How can we know the answer to that? The mere fact that she died does not mean anyone was responsible. You would have to prove serious negligence and malpractice lead directly to her death, and you probably can't.
