Hi You did not mention which country you are in . For a BI claim ( Bodily Injury Claim ) you must first prove that the other party is negligent to any compensation . If both are equally to blame the law says you get only 50 % on each head of the claim eg injury , earning etc 2 ZIf you were a PASSENGER in a car then blame is no issue you get 100% You are entitled to claim 1 Injury which is pain and suffering and can be more then any medical bill ! 2 Loss of earnings ( if you could not work and suffer loss thereby 3 Loss Of future earnings - for losses in the future if you cant work the same after the accident - example you can use your injured arm like before 4 Medical expenses
Most importantly if you were NOT a passenger please get proof that the party that knocked you was to be blamed for the accident to get the full sum !!!

In the US, the bodily injury liability portion is what covers the other party for their medical needs. If you werent at fault for the accident, you are claiming for this through the other parties insurance.
That will cover you for your medical expenses up to their limit of coverage.
If their coverage is not enough, you can use your uninsured motorist coverage to cover the difference. If you do not have this coverage, I will suggest that you take this to a higher level and court to collect for your medical expenses.

Yes. First your lawyer gets his cut, then the medical bills all get paid, and whatever is left over, you get for lost wages and pain and suffering.
