I am suing a Dr for malpractice & Negligence, and I signed the papers to release medical information for my son, however I know (I'm was a medical assistant- I just don't remember the answer to my own question lol) there is a certain amount of time that Dr's are "allowed" to present the records. How long is that?? I can't remember, and its driving me nuts. Any help would be appreciated! Thanks!!
No, there is certain set time set..legally. That they have to release the records...its like 60 days, or 6 months or something, but there is SOMETHING about a certain set time...i know it is a ridiculous amount of time given Dr's never want to give up information that could harm them. And i know since i have worked in Dr's offices it can be done in a much smaller amount of time, but I'm trying to figure out what the max time we wait is. Thanks
I could swear in MI there is a set time...Obviously I could be mistaken, the attorney just told me that the Dr's will take as long as they can to hand them over, and I remember when I worked in a Dr's office they would talk about how time was "almost up" to send the records.

There is no defined amount of time by law unless a judge orders it by a certain date, certain medical practices may have a policy which is what it sounds like you are remembering.
If the suit has been filed, and your attorney has requested the records, then they must be turned over in a reasonable amount of time. Your definition and mine of 'reasonable' may be far from each other.

I was a ROI Clerk@a hospital here in Henderson,NV for a year. And it would usually take 5-7 business days for our hospital to release info to lawyers. We accept subpoenas by droff off or mail authorizations w/pts signatures or notary. Then they are mailed out which can take another few days or can be picked up. I guess all medical offices and hospitals are different. Hope this helps...Have a Beautiful Day!
