I'm asking this question for my boyfriend. He seperated from his wife in Sept. 2005 and is still not divorced. They didn't have any children, but they did have a house and a timeshare. The house has already been sold and the assets were divided. The attorney did not help him at all, and in fact made him lose a lot of furniture, pictures, and other personal items. His "wife" is still using his medical coverage, and will continue to do so until the divorce is finalized. He has contacted his lawyer by phone and by email continually since late last year and the attorney has ignored all of his calls and messages...
Now my question is, what can he do to force this lawyer to finish the case, and just consider everything else a loss? Or should he get a new lawyer? If he did get a new lawyer, would he be able to sue the old one for the cost of everything he didn't do? And can the lawyer be reported to the Bar? Thanks in advance!

It can be, yes. Here's what I would do. Send the lawyer one last letter via certified mail saying that if he/she doesn't contact you, you're going to the bar with a formal malpractice complaint. If that doesn't work - give him a deadline to get back to you - you can file a grievance with the state bar. Just look up your state on the web - "state bar of x." You are free to hire another lawyer, of course. You can sue the lawyer for malpractice but the outcome is iffy - you could get everything you paid and more, or you could get nothing. And of course, it will cost you to file a lawsuit.

I guess it would probably depend on the state. Where I am, attys can get away with that crap. Mine quit 7 days before a custody hearing because she was intimidated by his atty. (I ended up winning but still!!!) I would suggest that he cut his loses and get another atty. Then, contact the state bar association and see what if anything he can do. GL!!

Contrary to what you have already been told, there are not enough facts in which to advice you whether a Judicial Ethics complaint would be warranted.
Now where have you specified what inaction on the attorney's part has caused the damages your boyfriend has suffered, if in fact, the damages were caused by incompetence or other factors or if the ex's actions have cause the cause to drag out.
The only relevant advice anyone can tell you is to have your boyfriend seek a consultation with a second attorney to review the case and advise.
