Can you file a medical malpractice suit against a doctor who no longer practices in an office setting. FYI - it is still within statute of limitations for New York State.

Well it depends on how long ago he stopped practice- I think there is a statute of limitations as to when you can file for things of this nature.
And then there is the question of whether it really WAS malpractice or not.

It depends on how long ago the alleged malpractice took place. I think there is a five year statute of limitations here, but I am not sure about New York State.

Yes you can. It doesn't matter if he is still in the office or retired. As long as you are within the statute of limitations, you can file.
