A very close friend of mine recently broke her right ankle in an ice skating accident. After we got to the hospital and had the X-rays done, it turned out that she needed a pin to be placed in her ankle to fix the break. After the surgery, the surgeon told her while she was still groggy from the anesthesia that there was a piece of -reamer- that broke off in her bone during the surgery. It is very apparent on the X-ray that there is at least a 3/4" piece of it embedded in the end of the hole in here leg where the pin is.
Additional note- When she woke up, the nurse asked her if she had just been crying, because there were what looked to be tears running down her cheeks. So to the best of my knowledge that means she felt an extreme amount of pain during the surgery.
My questions are the following- Does this constitute as medical malpractice and if so would anyone know how much compensation she would receive? (no we are not after the money, we just don't know)
-Since it cannot be removed from her bone due to its placement, what can be done about it?
-And what repercussions, damages and effects could this piece of surgical reamer have on her bone health, and structure?
