Every state has a different standard for medical malpractice and what constitutes this. You would have to check the civil code in your state to learn what that standard is. However, generally speaking, it is usually when a doctor does some irreparable harm to a patient which causes them damage to their body on a temporary or permanent basis, including death, which is determined to be due to their action or inaction.
