Hey guys, a question, when I was a minor, I had a major internal surgery to correct a problem, and this surgery turned out botched by malpractice, requiring extensive repairs and severely negative health effects, extreme loss of thousands upon thousands of dollars, and extraordinary loss of wages, quality of life, pain and suffering, and the shortening of my lifespan in general.

Because I was not able to take action for a year (my parents did not want to sue because they were having a sexual relationship with the surgeon at hand), the statute of limitations expired, and I can no longer sue for malpractice alone. Since I was a minor at the time and did not make any contracts of coarse, couldn't I sue this surgeon for kidnapping, imprisonment, forced consumption of anesthesia, torture, rape, conspiracy to contempt, ect ect, since the surgeon at hand did not warn me of the risks involving surgery and convinced me to undergo the surgery based on his solid explanation that it would end in solution? (just like a child molester holding out candy?) As a minor, I only willingly underwent this surgery because I was tricked into thinking it would benefit me, when malpractice indeed occurred oppositely (but sadly, our constitution appearantly says that you only have one year to sue for malpractice, but up to 5 years or so to sue for any other charge against a minor, like the ones mentioned above.)

Any thoughts on this? Like I said, I am only 20 now with a debt of around $ 30,000 because of these mandatory surgeries, and because of my health, I have not been able to attend school, work, or even casually do normal activities as I am in constant suffering - my surgical journey isn't even over, though the solution is almost near because I have at least found specialists I know can help me surgically. Thanks for all the input!

You have no case for those crimes. Your parents consented to your medical treatment.

You can't sue for kidnapping or rape because you weren't kidnapped or rape.You weren't tortured either you went under surgery that your parents signed for.

You may not be able to sue at this time but you could bring him up to the local medical board on malpractice charges, perhaps. Now if you were a minor when the surgery occurred, your parents had to sign for it, and they should be responsible for the bills, not you.

Ok well first up:

Where does the rape and theft come into it? And conspiracy to contempt? (Are you just adding random things to this?) Can you explain how he raped you or what theft was committed?

Secondly as a minor he does not require your consent, he requires your parents consent. Which i suspect he has.

However, as someone else has said. Yes, you can sue anyone for anything. Whether you win is another matter.

Maybe you should sue your parents if they were cavorting with the surgeon. But seriously in cases like this you need to consult with a lawyer who knows the law of your jurisdiction, the statues of limitation, the actions at law and the evidentiary requirements for a successful lawsuit. Obviously you will need one or more medical experts who are able to testify on your behalf and provide evidence that your prior doctor messed up. Your proposed legal actions may be a little far-fetched unless they are firmly grounded in the facts. That is why you need to go over all this in detail with your lawyer.

How can you sue for a crime that did not occur.

You said it was an operation.

There is no kidnap or rape involved.
I can not see your case.

The medical operation was sanctioned by your parents, who must have thought you needed the operation for some reason.
