My boyfriend recently broke his leg which required surgery. He had no visible wounds and checked out fine after the surgery. When he went to the flow-up they said everything was great and changed the dressings and cast. However, for the following days after that he complained that the top of his foot hurt really bad and was going numb. He was able to get an appointment about 4 days later and when they removed the dressings there was a puncture wound about the size of a half dollar. He was told that a vein had ruptured and that it had done some nerve damage. They also said they weren't sure if he would ever have feeling there again. I was wondering does he have a case and what issues he should sue for? Thanks!

You would need other doctors to say that he was not treated correct.y, before you could have a suit. Getting doctors to say
that other doctors have made mistakes is REALLY hard to do. The doctors who did the surgery can explain away most anything that occurs, such as your bf's wound. NO, it is not fair or right. That is just how it has been for my family.

to have a malpractice, you have to show that there was gross neglect by the physician , and the complication was due to neglect
It sounds rather difficult to prove this
If you will contact a lawyer, they may tell you there is a case, ,( they do that for almost every case, as they get paid if they win), but to actually go through the process it is rather difficult
I would just probably get a second opinion from a surgeon if you are not satisfied with the care

I wouldn't think so, but I'm in healthcare and not a lawyer. Although that is a very rare thing to happen, it is not the fault of his Dr. or the nurses who removed the dressing or cast. Its just one of those things. When he signed that form before he had surgery, it said that he understood all the risks that could happen and still agree to the surgery. Pretty much everything you can imagine is included in that waiver. Still, it was not their negligence that caused his vein to rupture. And you cannot tell immediately whether or not you will have nerve damage permenantly. It can take up to a year or longer for nerves to regenerate so not all hope is lost. Good luck to you guys.

You must be able to prove neglect by the dr's, go ahead and sue if you want to though, everyone else does that's why we all pay so much for insurance and routine procedures.
