If someone wants to sue a doctor for malpractice, do they have to file a police report and/or a complaint with the medical board before an attorney will consider taking it on? I'm not sure who to file the complaint with and what to do, so I contacted an attorney to represent me in the case but he said no because I didn't have anything filed against him. Should I ask another attorney or should I file charges first?
The "malpractice" is that he sexually assaulted during a paid visit which I've read is considered criminal.

Malpractice is a civil matter and the police do not handle it.

Medical malpractice is generally not a police matter. No police report or complaint to the medical board is required.
The attorney was probably talking about an "intent to sue" letter that has to be sent to the doctor within a specific time period called the "statute of limitations." Speak with another attorney who can explain this to you in a way that you are satisfied that you understand the procedure.

Find a firm that specializes in medical malpractice. A good firm will interview you in depth and then tell whether they will take your case and if not, why not. No prior filings are required.
