There is no set lenght of time but they will contact the lawyer immediately after receiving and processing the paperwork. The insurance company will then do an investigation even if the client was negligent. How complicated the case is usually the biggest factor in the time that it takes. They will normally offer to settle to keep the case out of court but if they think the plaintiff is asking too much or if they think fraud may be involved they may not offer.

Sometimes they offer to settle. Sometimes they just wait until a hearing date is assigned, and settle then.

The insurance company will NORMALLY go take pictures and statements, request your medical records, etc.

They won't necessarily contact the plaintiff's lawyer until AFTER they receive suit papers.

See, landlords - especially for high traffic premises like apartment buildings, stores, restaurants - can get 3-10 demand letters A MONTH. So landlords usually IGNORE these demand letters, until a suit is actually filed. Even if they turn them in, when the landlord gets frequent demand letters, the INSURANCE company doesn't start the whole investigation thing - they consider it a "notice of POTENTIAL claim" until after the suit papers are received.

It's a quantity issue. So, you don't USUALLY get the ball rolling, until after SUIT papers are filed.

It's different with homeowners, if they get one claim EVER, it sends them all into a tizzy, so they are usually much more prompt about doing things.
