The pilot is given hold short instructions by atc, but mistakenly crosses the runway. Nobody was injured but it could have been a hazard. NTSB suspends his cert. What rule of law was this based off? Ex. tort of negligence, assault...? What would it be... obviously not the examples I listed but what?

There is no rule of law that supports the FAA decision. The NTSB does not have any authority to suspend a certification of a pilot.

The FAA establishes regulations and rules and is the sole enforcer. ATC is the administrative functionary of the FAA that is in direct control of air traffic when in controlled airspace or controlled airports on the ground. Failure to follow instructions from ATC is grounds alone without supporting rule of law.
