I was seen at the Emergency room at a hospital (by way of ambulance) for serious vaginal bleeding (at 9 weeks of pregnancy.) I was given a prognosis of subcoreanic hemorage and sent on my way. I was told bleeding would slow then stop. I was told that if I was to have a miscarriage it would have absolutely nothing to do with this. I then called my ob/gyn at her office and told there was no reason to see me I should just take it easy. Now 3 weeks later (still bleeding off and on) I start having bad pain progressing worse and passing blood clots. I called and spoke with the on call doctor (it was after hours.) I was instructed that since the blood was dark colored and clots that it was "old" blood and Im fine. I called back an hour later. was told the same thing. I called back a couple hours later saying I was doubled over in 9/10 pain and crying. I was instructed (All these conversations with same doctor) DO NOT go to the hospital it is normal. She then sent a prescription to my pharmacy for pain meds. Then for another opinion I called the advice nurse at a different Hospital and was also told what I am going through is normal, no need to come in, just relax. 4-5 hours later I go to the bathroom while in excruciating pain and feel what I think is a blood clot. My husband comes in to look because it was hanging out of me and it was a completely (to me) formed baby. My husband immediately called 911. The baby passed in to the toilet. The ambulance staff asked me why I wasnt in the hospital hours ago. I told them my doctor and the advise nurse said do not go everything is normal (My doctor office nurse said that also.) They responded by shaking there heads and telling me specifically that I should have been instructed to go to the E.R. Hours ago. Now I know that if I had gone they would have known I was dialating and could have given me medicine to stop the process and would have had possibilitys of saving this pregnancy. I know of women who had this "labor" stop 3 times by 12 weeks and then went on to have a healthy baby. I saw the same doctor in the E.R. that I seen the first E.R. visit. This time he diagnosed SUDDEN Miscarriage no cause, no reason. We know for a fact (especially being told by everyother doctor) that it is the same issue. Even though this same doctor just told us weeks ago (with witnesses) that if she were to miscarry it would have absolutely nothing to do with this problem. Now I have lost my baby, Im emotionally a wreck as well as my husband. I was lied to and misdiagnosed by the E.R. doctor and if my doctor and the advise nurse did not specifically instruct me not to go to the hospital and I was given correct info. I may still have my baby. This effects the rest of my life and my husbands. Not to mention this "normal" definition seems rediculous. To my knowledge only 1-3% of all woman in the U.S. have a subcoreanic hemorage and about half of those people have miscarriages. To tell us we are in the clear is just a laugh in the face of medicine. And everyone telling me Gushing Blood and Blood clots and Extreme Severe pain is "normal" in fact a simple google shows that severe pain is not normal. The doctor told me on the phone "its just your body dealing with the blood clots inside you" WRONG I was basically going through labor, having labor pains/contractions (Ive always had C-sections so I didnt know what they were) and dilating. I would like to take absolutely any action possible. As you can imagine I am very upset and hurt. I blame them, with the correct information there was a chance, now my baby is gone forever. Nothing will ever bring him/her back and the image of my little baby will be imprinted on me for the rest of my life. For god sakes when I tell the doctor or advise nurse something minor they say come in if you think you should, this time "DONT COME IN" The phone record with the advise nurse is recorded so I know there is record. And one specific person on the ambulance was so disgusted with the situation she was almost in tears and I believe she would back me. And the E.R. doctors two different evaluations are recorded. This is just rediculous. Im sorry if I went on too much. I very much hope you can help me. I even have a picture showing the size of the blood clots I was Having (As long as a dollar bill and as thick as 8 quarters.) IF as soon as I was having pain I went to the doctor they could have found out if I was dilating etc. etc. And if at that point there was a heartbeat they could have stopped "labor." Now we will never know! Of course its the weekend and I cant get ahold of an attorney. I know this is no substitute for an attorney I just want to know what everyone else thinks. See a lawyer that specializes in medical malpractice, ASAP. It certainly sounds like you have a case, but what do I know? I'm not a lawyer, although I have taken law classes.

I am So, So sorry for your loss. Nothing feels worse then losing a child.

I would hope you have something here. The problem of course is that every member of a medical team will try to cover the others ass. Unless you have hard core proof then you will never win a case. You will see witness that wern't even in the room suddenly remember that they heard the Dr. advise you to come back if you are concerned or some such thing. I hope you can nail them to the wall but the fact is they have big lawyers and multi million dollar insurance policies. I know you want them to pay for what they have done and money won't do that. Chances are even if you do have a case they will offer you a settlement and the D.r. will go scot free. Not even a blemish. Unfortunetly that;s how it works. Rarely is there justice.

Malpractice? Yes. All the major elements of a case are there. Wrongful death? I doubt it.

You need a real lawyer. I'm familiar with what will and won't get me sued for malpractice but that's it.

You have a Medical Malpractice case because a negligent action of medical professionals resulting in an wrongful death of a child. Im very sorry about your loss but you really need to get an attorney. They failed to diagnose you in a timely manner, Improper treatment/delay in treatment.
