yes I am way over 18 when i bring it up they do not want to talk about it ignore or make fun then kind of brag were not going to sue! say if I want to get medical records or sue will block me from ever doing so then it bothers me cause I know statue of limitations slip away

p.s. it bothers me if i hear em then nitpick in restaurant or don't have time yet then go to zoo & feed some goats

Just as an over all observation, as long as you're over eighteen years of age, no one can stop you from filing this malpractice suit.

There are all sorts of legal problems that you might be up against if you do so. Depending on the family member that died, were they mentally incapacitated and had a durable power of attorney for health care document? If so, the first agent makes all health care decisions and I would think would be able to block your attempt at filing a malpractice suit.

If you really want to do this...look in your local yellow pages for the 'District Attorney's Office'. There should be a telephone number for the legal aid department (they are lawyers who represent people who can't pay for it). They will be able to tell you if this malpractice suit is worth filing or not. Good luck.

As you are an adult, regardless of the other family members, if you believe there are grounds for suit, I suggest you consult an attorney at least to explore the issue. It is likely that this is the only way to set your mind at ease over this issue, whichever way it goes, and yes, you should not let time slip away.

You gave us no information so I question whether you want help or just want to complain. Whether or not you can sue depends on your relationship to the deceased, not on agreement among family members.

People get cdiff in the hospital, its a common infection. And they do give chemo to people with the infection, a lot of times its the chemo making the immune system so weak that causes the infection.

What you dont tell us is what the actual cause of death was. I mean, did the infection cause her death or was it something else? If you want to sue you need to get the full records and talk to a lawyers.

In the end though, the only thing that will make you feel better is accepting that it was her time to go. Even if you go to court and win, you wont feel better until you just accept that it was her time.

Have you considered a grief counselor or a support group? I think that could go a long way in helping you deal with this.
