I rear ended someone yesterday, and I got a call from my insurance company today that the driver's lawyer filed a claim. Her car looks fine, just a few scratches on the bumper, but who knows. I wasn't going very fast, but it was raining and I skidded. I'm more concerned about medical claims, especially because she is 7 months pregnant (she was fine at the time). My insurance is alright, but i was concerned when the agent suggested I up everything for "next time".

I have never been in an accident before so I really don't know what to expect. Should I be worried? Are there limits? Should/can I do anything?

It isn't that I am trying to get out of any responsibility, I just don't want to get saddled with a problem I didn't create (i.e. normal pregnancy aches and pains).

you can do a counter sue and she can file a lawsuit any one can sue that was involved in the accident i suggest u get a lawyer i have been there and if u got a good insurance company u should never hear about it!@

Well, you need to figure out how much coverage you have in liability on your policy versus how much her lawyer is asking for. It probably won't be much, but if next time you hit a minivan full of kids and they are all hospitalized for long periods of time....the medical expenses will rise very quickly. Any amount that their medical expenses rise above what your maximum coverage is with insurance....is what you will be responsible for paying out of your pocket.

In USA anybody can sue for anything. This is a FREE country - free to do just about anything (stupid - I know).

that is not a necessarily a law suit. A claim is what people normally do in any accident damage (assuming damage).

Now your own insurance agent it trying to hit you. Don't get me wrong. Extra insurance is great. But often lawyers check your policy limit and often decide NOT to sue if the limit is very low.

But they really do come into use if you were to have a GIANT accident.

you were in an accident YESTERDAY, and today you heard from their LAWYER today ????? sounds to me it was staged....that's when someone jams on their brakes only to cause an accident and then sue some poor chump's rear end like yours.....God help ya.....i sincerely hope the owner of the vehicle you were driving is BROKE, so that woman can't collect a dime.............PS ...WHY DID SHE STOP SO SHORT ? get yourself a lawyer ASAP.........look for the slimiest, cigar smokin', disgusting attorney that looks like he crawled out from under a rock....that's your man.

She can sue.. anyone can sue for anything. The best for you to do is turn this over to your insurance company and let the deal with it. That is what you pay them for.

don't worry. the damage is done. accidents happen. it just gets me real mad when this happens. if that other person would have followed the rules about having insurance. and stayed home. and not drive. all this would not had happen. just wait and see what happens.

Yes, you can be sued. But the good news is your insurance policy promises to defend you. Ie. pay the legal costs plus any damages. I have very serious injuries from an accident that I didn't think I was hurt at the time. They usually don't show until later especially if it's the spine. Keep talking to the agent and do what they insurance company tells you to do. Be concerned but don't worry too much. You should try to see if the other driver had any injury, if you can. You usually cannot communicate with the other driver, though. Insurance doesn't decide you are a bad guy and not pay; they pay regardless of fault.

Any one can sue any body for just about anything. Assuming you have liability insurance (this is required by law in every state) your insurance company is obligated to defend you in that suit up to your policy limits. If you have minimum limits and the claimant is successful in court for an amount exceeding your limits, you could be on the hook for the excess amount.r

You have insurance, You shouldn't be worried. You will be protected up to the limits of your policy. You will probably be ok but you were most likely given some good advice to "up" your coverage for "next time". Always buy as much coverage as you can comfortably afford. You need to protect your assets and your future earnings. Don't get paranoid and buy too much though. As in everything, use your common sense.
You will be just fine....
