Tips: Do I have a malpractice case?

August 14.07 i had went to the E.R complaining about not being able to hold any food down for 3 days and stomach pain.i was 2 months prego. i had passed out in their emergency room they took me in pumped me with I.V. scheduled an appointment to see the OB GYN gave me nausea pills and sent me home. August 17.07 i got rushed to the hospital i lost my baby my fillopian tube and my ovary and almost lost my life in the process i feel like the E.R failed to do their job even though all the symptoms of an ectopic pregnancy was in their face maybe if they would of looked this would of never happend to me. Could you help me?



Any of the following additional symptoms can suggest an ectopic pregnancy:

* vaginal spotting or bleeding
* dizziness or fainting (caused by blood loss)
* low blood pressure (also caused by blood loss)
* lower back pain
they gave me a urine test and blood out of me idont understand how they didn't realize i was suffering from an ectopic pregnancy

You should probably consult a lawyer for questions about malpractice. It does not sound like they did a thorough enough job, but then again since you weren't complaining of pain in the area of your fallopian tubes, I don't know if it's something they definitely should have thought of. So, again, if you're serious about the lawsuit, ask a lawyer about it.

You said you went to the ER complaining of stomach pain and not being able to hold any food down. You did NOT say that you complained of vaginal spotting or bleeding or lower back pain.

The episode of passing out COULD have been associated with blood loss if you were experiencing that, but were you experiencing that? Since you complained of not holding food down for several days, they probably associated the passing out with dehydration, hence their pumping fluids into you.

You MAY have a malpractice case, but they are very difficult to prove and unless you can show that they neglected you in some way you will not win. The medical community does not know everything, they can only treat based on the symptoms they see or are told of. There were THOUSANDS of possibilities for the problems you say you went to the ER complaining of.

When was your appointment scheduled for, with the OB/GYN? Did you keep that appointment? Did s/he notice any concerns?

I truly am sorry for your loss. And, I understand the desire to put the blame somewhere. I am not trying to belittle you at all. I just want to point out that doctors/nurses are not perfect, and that a malpractice suit will be difficult and possibly cause you more stress.

Unfortuantly this is a common thing that can happen because ectopic pregnancy can present like the flu, early miscarriage and many other things. It is just like how they miss Ovarian cancer in so many woman or breast cancer even though some of the signs are there. Where you having spotting or severe bleeding vaginally? Did they check for a heartbeat or do an ultrasound to check the baby? Had you already seen an OBGYN and if so why didn't they do an ultrasound to verify where the baby was located (this is common practice around here because of ectopics). Did you have the lower back pain? Was your blood pressure low? You would need all the information but even then you could file but would probably not win the case as they are Dr's but still human and if it seemed like you had the flu or even if they felt it was a possible miscarriage coming on then there would be nothing they could have done. I wish that they had a way of knowing these things and when they find a common link they can but for right now so many health problems and risks show similar signs so they can only go down the list of possibilities to see what you have. By setting up an appointment with the OBGYN they were advising you to see your OBGYN who would have checked you for ectopic as that is what they specialize in. ER Dr's specialize in Emergency Medicine.

I don't think you do. You didn't have any spotting or bleeding, and you weren't complaining of lower back pain. Nausea is a very common pregnancy complaint (as I'm sure you know) and one of the side effects of sever morning sickness is dehydration. Dehydration causes low blood pressure and fainting/dizziness.

It sounds to me like they heard your complaints, (I'm assuming drew some blood??) found you to be dehydrated, gave you fluids and a prescription to treat your symptoms and set you up with a follow up with your OB.

It would have been thorough of them to do an ultrasound and check for an ectopic pregnancy or other complications, but unless you were describing sever/acute abdominal pain, or you had a history of high risk or ectopic pregnancy, this is not routine.

I'm sorry for everything you went through, I don't know if this will make you feel any better, but unfortunately even if they HAD diagnosed the ectopic pregnancy, they wouldn't have been able to save the baby.

I'm sorry for your loss. It's tough. My SIL had an ectopic and lost her fallopian tube and ovary as well many years ago. However, she presented with clear indication of ectopic symptoms despite the fact that the pregnancy test did not show her to be pregnant. The pain was severe. She could not have made it to the ER under her own power.

You would have to check with a lawyer, but I personally don't think you have a case. The symptoms you suggested can be many things. Dizziness, fainting, stomach pain are actually very common complaints for any number of conditions including just plain pregnancy (not ectopic).

I'm very sorry for your loss but how can you say that all the symptoms were in their face? It was so recent and I can see why you'd want to blame someone for something that was unavoidable...but the only symptom you had was that you fainted...if you were two months pregnant hadn't you had an ultrasound to confirm the pregnancy yet? THAT's when they could've seen where the baby was...unfortunatly, ER visits are so expensive and usually rushed for time...they can't possibly US check every pregnant woman who comes in and says that can't hold down their food...that's like the number one side effect of being pregnant...please don't think I am being mean...I really do feel for you. I can't imagine anything worse...I just think you need to give them a break...how could anyone have known based on your symptoms that weren't "in their face"
