How can you prove neglect if the mother leaves the child for 3 days at a time with grandparents? The mother provides no clothing, no food, and when called on the cell phone does not respond if the child is in need of medical care. The child is not neglected because grandparents take care of the child. However, if they were not there, the child would most likely be neglected. How can grandparents get legal custody in this situation?

Grandparent custody is treated very differently from state to state. However, in most states the MGP's could file a complaint with CPS, then get the child out of foster care by relative placement. In some states they could simply file for custody and have a hearing. You assume they have to prove criminal neglect to get the child. Not true. Custody is decided by what's in the child's best interests.
