Democrats were more than willing to celebrate the numbers from the CBO in this same report, yet they are still a hard sell for tort reform.

Why?

"Lawmakers could save as much as $ 54 billion over the next decade by imposing an array of new limits on medical malpractice lawsuits, congressional budget analysts said today -- a substantial sum that could help cover the cost of President Obama's overhaul of the nation's health system."

What Will America Be In 4 Years
Because most the people that sue doctors are from AC0RN and SEIU , they love getting money they don't deserve and too destroy the American system.

Plus all the govt we got now are Trial and Tort Lawyers- they even hired a Czar who wants animals to sue people now- the more they destroy us people the more they get ! Its all about them! They are selfish greedy people!

This is why so many doctors don't support that bill! 45% of them said they will quit or retire early under Obama care- Heck, they will get much less be watched over and told what test they are allowed to use on us, in turn get sued MORE! They already pay 200k a year just for Malpractice insurance.!

Because lawyers are the Democrats' base. They're being paid off.

Real American
becase liberals have no intention of fixing anything...they want to control every aspect of your life

chris s
because the lawyers lobbyists line their pockets

guber
The Democrats are all Tort Law Attorneys.

Ryde-On
95% of Democratic politicians are lawyers and they get lots and lots of contributions from other lawyers.

Tort reform is bad for the lawyer business.

Uhh, let me see, Obama is a lawyer as are almost all of the congress, they made a deal with the trail lawyers to keep tort reform out of Obamacare. Easy enough even for liberals to understand.

The end justifies the means. They want government control of people's daily lives. The money does not matter, liberty does not matter, the only thing that matters to Liberals and Democrats is power and control.

I 100% agree with you zaza. Tort reform should be in the bill.

Actual lawsuit awards are a minimal contributor to medical costs.

Now, the insurers probably raise the cost of malpractice premiums to make more profits, and use the boogeyman of the lawsuit to justify it, but those increases do not track with actual malpractice costs.

So, if we limit the legal remedies, and the premiums charged are not based on costs, why would those premiums come down?

Also, what's the cost? Are the costs of medical malpractice based on frivolous lawsuits, or legitimate claims? If we put strict limits on the cost of screwing up and killing someone, what will happen to the quality of care?

If we passed single-payer, where there is no incentive to short-change people for corporate profits, then, yes, those limitations would make more sense. The for-profit system has a well-established history of screwing over the policyholders as much as they can.

This would be, essentially, another form of de-regulation to increase profits.

We saw how well that worked for the mortgage, banking and financial industries. Unless the tort remedies are accompanied by a set of stricter standards and regulations, removing that protection for the average person is a bad idea.
