I recently had a spinal fusion, 4 screws, 2 rods and a disk spacer put into my L-4 and L-5 vertebrates.. During my 2 month check-up, I stated to my doctor that I was still experiencing pain down my leg to my ankle and a burning sensation...He said " well I wasn't going to tell you because I didn't want to upset you or make you worry if it was nothing.. He told me after looking at my x-rays that 1 of the screws he put in was put in lower than where he wanted it to go, therefore pressing on my nerve.... He said" Now I can reopen you and take the screw out and put it back in where it belongs"..It would be up to me..Doing this would mean another $ 50K in doctor bills and a $ 65K in hospital bills, not to mention 8-10 weeks off work for recovery...Any input or direction I could get would be great.. I am still after 8 months on pain pills and in extreme pain, I can only lift 20 pounds so this affects my work.. Also still not back to a 40 hour work week, currently working apprx 20-25 hrs a week, thats all I can stand..

Accidents do happen in surgery which is why you sign a release form, but I think you have a good case for negligence as doctors are supposed to be professionals. Insurance should cover most of the costs, but in this case, I think the doctor should reopen the original scar and reposition the screw for free, but its not likely to happen. The insurance company can refuse payment on the grounds that it was not a properly done procedure.

Yes. Your surgeon failed to meet the standard of care.

You need a lawyer and a better surgeon. There is no excuse for inappropriate placement of screws.

You should talk with a civil attorney. Maybe you could find one that gives a free consultation. Attorneys used to advertise free consultations in the yellow pages so you might try the yellow pages online. I would get at least two opinions.
