surgeon is a incorporated Is he protected under medical malpractice . Does corporate insurance cover his actions

The fact that a doctor forms a PC, professional corporation, or any other corporation, this will not protect him/her in the case of malpractice. This is the reason that all doctors/medical professionals must obtain malpractice insurance. I am sure it is a requirement to practice in most states.

But, to answer your question, a corporation will not protect anyone in the case of malpractice or gross negligence. The veil will be pierced and the court will treat the corporation as if it doesn't exist; meaning that the doctor's liability from judgment will now reach to his/her personal assets.

Hope that helps.
