How to go about Sueing a vet?

Posted by 70sfamily | 8:03:00 PM

In small claims court for vet bills caused by their malpractice and inadequate sterilization during a surgical procedure that almost resulted in death. My new ver bills total at 3395.28, for a sterilization done for 220 flat.

I have both vet files, I have pictures of the infection left inside by dog, and I have reports stating my dog was anemic, dehydrated, severely infected (Blood tests), and the biopsy report from the 3 masses of infection that glued my dogs organs together.

The second vet says I have an extremely good case against the first, and the board for the vets say I need to sue them.

How do I go about suing them? I'm 20, and have no clue how to get started.

Go on line. There are websites instructing you on how to start a small claims law suit. You can even download the forms.

Open the yellow pages. Look for attorneys. Look for medical malpractice. Call one and talk to them and they will tell you all you need to know.
Added: You should talk to an attorney for this. Professional malpractice is usually not handled as a small claim.

go to see a solicitor - they can get the process started

You are going to need a lawyer. This isn't really appropriate for small claims, since it will involve technical issues and contrasting expert opinion.

Have you exhausted all avenues of settlement? Once you add in a lawyer, it could cost you as much as you're suing for. An out of court settlement is a far better option for both of you.

Go online. Your state/county likely posts all small claims information on the internet. You should be able to download the appropriate forms and directions. Just download the information, and read.

Contrary to other answerers, your case is very appropriate for small claims. The most you will recover, presuming you win, will be $ 3175.28. Regular civil court is not the place for such a small sum of money. You can bring experts, such as the second vet, with you to small claims court.

But before you file a lawsuit, bring all this to the attention of the first vet. Maybe you can settle this amicably without going to court.
