This is an extremely stupid question. Abortions are not performed on women who are about to go into labor, and no amount of incompetence on the part of hospital staff would result in you having an abortion in such a scenario.

There are two separate institutions where these generally take place, this will eleviate the problems with accidental abortions. In the event that the cab driver clubs it it woudl be murder.

they would be charged with a LOT...medical battery, criminal negligence, violation on the ban on partial birth abortion (i believe all states do NOT allow abortions past the third trimester). They would be in big trouble.
The driver would get aggravated assault and battery. If the child dies it would be murder.
