Is it a medical malpratice?

I had a miscarriage after a 2-month pregnancy because the fetus didn't have heartbeat anymore. My OB/GYN doctor referred me to her colleague for the surgery due to her booked schedule. This doctor performed a D&C surgery on 07/28/2007. Since then, I haven't had my period. After surgery, my OB/GYN doctor didn't do any follow-up checkup on my uterus condition because this health center doesn't have proper ultrasound equipment. She kept telling me that if I didn't bleed after surgery, there should be no problem. She wanted me not to worry.

I realized that health center can not provide appropriate service, so I went back to see my infertility doctor on 10/22/2007 and was informed that my uterus has been seriously damaged. I need at least 3 re-construction surgeries to open up my uterus and restore its function. Besides, he can not promise me if I can get pregnant again.

Can anyone tell me if this is a malpractice?

For something as serious as this, you should call an ATTORNEY. I realize that people want other people's advice and opinions, but you're talking about legality. You need a professional.

That's terrible. My opinion is yes, that is malpractice. You should contact a lawyer and find any evidence you can against them. Do everything you can to fight these guys!

Sure sounds like it to me. Go to a third OB/GYN and get a lawyer who specializes in medical malpractice to review all the info after that.

You need to first find out what caused the damage. A miscarriage in itself can cause damage to your insides. If you end up finding that the cause was due to the d & c because of negligence and could have been avoided then it is malpractice and you have a good lawsuit.

I agree you need a law professional... on the surface it would appear you have grounds for a malpractice suite...but only a malpractice attorney can tell you for certain.

this sound quite serious..... I believe you should consult a lawyer who specializes in medical cases...who can then better asses you situation
