My friend has been in need of a root canal for some time now. She was able to find a practice that would do one for around $ 400 which was all that she could afford. One of the secretaries mis scheduled her though and her appointment was pushed back until the late this month. Then yesterday the secretary leaves her a message saying that they scheduled her with the wrong dentist and he doesn't do root canals so she will have to wait until January. Now for some time shes been on an anti biotic until she could get a root canal and because of this and the fact that her doctor was aware that she was going to have it done this month, she won't be able to get anymore. This means she have to have the tooth pulled because of incompetence on the dental offices part. Is there any legal recourse here? Malpractice or negligence?

You have no legal recourse. There is no law against being an incompetent secretary or employing one (although there should be).

No malpractice as they have not even seen her. No negligence because they have not seen her. Your friend has needed it for some time and waited until she could afford it. This is not the dentists fault.
