I gave birth to my daughter 8 months ago. I was just having a slight elevation of blood pressure, nothing more. Once I delivered the baby I started to have extreme fevers, chills, fluid on my lungs, body pains, stomach pains. Burning when urinating. I had numerous x rays and ct scans along with ultrasounds done to find that there was 2 pieces of gauzes left inside my vagina. Once they were passed my symptoms were subsided and I got better. I was in the hospital for 2 weeks and was not able to be with my new born daughter. I had pylenophritis, urinary tract infection, bladder infection, uterus infections, fluid around my heart and lungs. I still have ovarian pain till this day. I still have the gauze and all the labs stating what happened. What do I do?

You can sue, but it is not medical malpractice. It IS negligence. A good lawyer will be able to tell you what the legal difference is between the two. You do have a good case.

You need to see a malpractice attorney! Yes this is considered malpractice. It is sometimes hard to get an attorney in the same town to accept a case against a doctor unless you live in a large city. You may have to go to another city close by if you live in a small town.
Most malpractice attorneys give free consultations. Look in the yellow pages for one and call for an appointment for a free consultation. They won't take your case if they don't think they can win. But if they tell you they don't want your case, ask if it's because they don't think you have a case or is it because they are in the same town. Sometimes they can refer you to someone else.
Good luck! I can tell you right now it will be a long drawn out process, but worth it!

I am not big on lawsuits so in my opinion unless I suffered permanent damage or it left me with extreme medical bills I would not sue. If it were just medical bills I would approach the hospital about having them either pay you for all the medical bills you had to pay in exchange for you not suing them. But I can tell you it is probably negligence at the very least.

File a complaint with your state medical board. Contact an attorney.
I work for my county medical society, I hear people complain about a lot of things that AREN'T malpractice. You have an excellent case, but please don't try to screw everybody....go after the doctor that made the mistake. It was HIS fault, not some nurse that touched you once to take your pulse.
