I am seeing an Endocrinologist and i have been seeing them almost a year. I am an FTM Transsexual and they do not have any experience in treating Trans people.
When i went in, i had already previously seen an Endo who was very experienced in the Trans feild and i had my files transferred from that doctor to this doctor.
When i started out on my Medication the Doctor and i agreed to start off low and work to higher and higher dosages. So i started out on 50mg bi-weekly IM injection of testosterone. When i got my blood levels checked the Dr. said my levels were 572 and i could not up my dose to 75 which was the plan, and that i could NEVER move up. This was 9 months ago. Every appointment ive had i have tried to make the Dr. See that even though my levels were in "range" they were on the lower end of the spectrum and that not only was every ftm guy i had talked to (which was ALOT) on double or tripple my dose. But i myself with an experienced Dr. was on 350Mg more a month before. I also tried to explain that i was still menstruating and that i am not on enough medication otherwise that would have stopped. But she claimed moving me up would be "malpractice"
At my last app my levels were at 100 which is ALOT lower then 572. Since i was on injection it fluctuates. And i was already asking to switcher to a gel form at this app. Which would give me a much straighter level because its applied every day. Range is between 2-300 to 1100 so despite the fact i was below at that app the Dr. still didnt move me up and said i had to wait to see what my levels were now that im on the gel. Which is another 3 months.
so basically.
The Dr will not listen to me.
Has strung me along for a whole year.
I asked them to consult with my old Endo they said "they never called back"
I am still menstruating and basically gaining hardly ANY secondary male characteristics. Which is the etire reason i see this doc and the whole point of the medicine.
The period should have stopped between 6-9 months ago.
The dr never told me when to get my levels done in order to obtain a better level read.
To my knowledge the dr has not looked into how to treat a trans patient.
The lack of proper treatment has been emotionally and psychically damaging to me.
And the biggest one is i have heard a few people tell me that the fact that i have not been treated correctly and have been on too low a dose. (which i looked in books the dose is too low) But that it can cause harm to my body and actually hurt me.
I'm not saying i would sue this Dr. cuz im not that type of person. but they have not only wasted a year of my life and of my transition, but they are also supposedly jeopardizing my health.
So could i sue them for Malpractice or any other things?
Thanks for your time and help
For Armin: Actually i Have suffered and am traumatized. You apparently not only dont seem to lack education in law, but dont have much in being a transsexual either.
First of transsexualism itself is traumatizing. Not to mention if the Dr. Had treated me correctly, i would have been fine 6 months ago. But the fact they havn't not only traumatizes me because i have to continue looking and feeling the same way i did when i came in, when it should have been fixed 6 months ago. But i still receive menstruation which is even more traumatizing for someone like me to deal with.
Also they dont "know what they're doing" If they knew what they were doing i would't need a new Dr. I wouldn't be in the same stage of transition i am in. And i wouldn't be questiong to sue to begin with!
For Belle: Thank you for your answer but i disagree because..In order for the Dr to deem something to be "too Risky" They would need proof. My level was Below where it should be and the Dr. Refused to up the dose and also is making me wait another 3 months of my life on the wrong dose. If range was 300-1100 and i was at 800 i can agree that could seem risky to increase. but the level was 572 and then 100and 100 isnt even in range to begin with.
If your a Psychiatrist you should know, if you perspiring lithium to a and there level is fine but they are still showing too many symptoms even then you may consider an increase, let alone if there lithium was too low. I highly doubt that if someone on lithium was acting skitzo and there levels were too low and they said they needed more help, you would say...hmm well your levels IS to low but lets wait three months and well talk then. You very well know if that patient commits suicide in that three months YOU could be held responsible.

sue for what?? you havent suffered you're not tromitized, these are trained doctors they know what they are doing if they did what you did and you died or suffered a bad side effect you would be pissed and would then sue them for doing what a patient said, not just because you think you can do it means you can, trust them

Hi
you can not sue as doctors can deemed something to risky to do and therefore refuse and be within there rights,
personally I would find another dr with more experience in this field and that will listen to u

Don't let folks on this board give you any sh*t-- ya hear! You're a brave person, living the life you were called to live, and you've got bigger cajones than most of the men here! (Who, I am assuming, will try to take pot shots at you-- they better not!)
So, you might have a suit. The duty of care in an action like this is judged against the professional standard. If you can show that a professional endo, with suitable training, would have pursued another course of treatment under these circumstances, and that this dr. did not act in conformity with generally accepted norms, and that this breach caused you damages, then you have a lawsuit.
I would check out http://www.lambdalegal.org and other related sites to get in touch with a more informed public. Sounds like this person didn't do her job. There are lawyers who specialize in this area. You'll definitely want to see a new doctor too, but I might talk to a few attorneys before then. Get all your files ASAP too.
Good luck.

You could try and sue but without being able to prove any real damages you will have a hard time of it. (by damages I mean gaping wounds or scars that others can easily relate to)
Then on top of that you will run head on into passive discrimination.
Transfer to another doctor.

It's perfectly legal for your doctor to refuse to do something with which they do not feel comfortable. It sounds like the main problem here is that you are seeing a doctor who is not experienced in the special needs of a transexual. Contact your health care provider and request to be switched to another doctor.
